2011 Sportwagen TDI cooling fan

I am hoping for some insight on my 2011 Sportwagen TDI manual trans.

After replacing the Intercooler My cooling fan appears to have rubbed against the boost pipe to the Intercooler and caused it to fail catastrophically.

Can I use an aftermarket fan and or controller. Some of the universal mount fans appear shallower by about 3/4 of an inch.

Has anyone heard of or run into the fan rubbing on the boost pipe? Can you use an aftermarket fan without throwing codes?

Any help or thoughts would be appreciated.
