    EPA Levies Millions in Fines Against Manufacturers of “DPF Delete” ProductsEdge Products fined $500,000 while other manufactures and marketers of pollution-control-defeat products face fines in the tens of millions; EPA actions puts end to popular diesel pickup performance practices

    Edge Products, which voluntarily stopped the sale and production of programmers designed to bypass the pollution control systems on late-model diesel pickups almost two years ago, reached a $500,000 settlement agreement with the EPA.

    EPA estimates that the illegal devices sold by Edge will result in 158 tons of excess PM emissions, or the equivalent to the emissions from 422 new long-haul semi trucks operating for a period of 29 years.
    It is also reported the EPA fined H&S, a manufacturer of both programmers and DPF-Delete exhaust kits and related products, $96M for violating the federal Clean Air Act.
    Sources say other manufacturers, retailers and installers are facing, or likely to face, similar legal action by the EPA. (Link to EPA Criminal Reports.)
    As ProPickup reported earlier on DPF Deletes, Edge was only one of a dozen companies that were manufacturing and selling products designed for “race-only” diesel applications but ending up on pickups driven on the street.
    According to the EPA’s enforcement division statement, Edge’s racing arm sold more than 9,000 electronic tuners designed for racing purposes.
    As part of the EPA settlement, Edge is required to spend at least $157,600 to fund an “emission mitigation project” to offset the excess PM emissions resulting from the use of its devices.
    TheEPA settlement statement says the funds provided by Edge will be offered as rebates to individuals who own old wood-burning stoves and who wish to replace them with cleaner burning appliances such as new pellet stoves or EPA-certified wood stoves in selected geographic areas with severe PM pollution.
    The rebate program, which is said to offer buyers of the Edge Racing tuners a $1,000 if they return the products, will be implemented by an independent third party selected solely by Edge.
    Further details about the rebate program, including eligibility requirements, will be available after the third party has been selected.

    I mean...that should be a way for the manufacturer to not be liable...

    Do any of these delete product suppliers get the purchaser to sign a document saying that the vehicle will not be driven on public roads?

    I guess then the EPA could go after the end-user?

    No idea on the legality of it all...jus theorizing...

    I doubt that would work if the vehicle in question is registered. If it has a license plate, or was driven to and from the shop where the deletes were installed, the shop that installed them had prima facie evidence that the vehicle is being used on public roads.

    Now if the vehicle in question didn't have plates, and showed up and was taken away on a trailer, and the owner signed such a document, then the shop might have a defensible case.

    Well when the proprietors sole business model is based upon the illegal act of circumventing the EPA's Clean Air Act. or the DMCA
    More specifically, tampering, altering, and defeating emissions devices; or an access control protective protocol device.

    Ahhhh .........No way you are getting out of that liability, when setting readiness monitors to always ready; in the name of "off road use".

    What leg would any tuner have to stand on, when leaving the VIN#, and then setting of the readiness set to ready?

    This is to only be conceived as a nefarious act, and only to be used to mislead a Governing authority; as a willful fraudulent act by means of spoofing.


    That is why we take existing tuners used ecu's we acquire.......... which fail SMOG, and via due diligence, strip the VIN # writing the customers name to eeprom;, and further note it is "for off road use".
    We also strip the Emissions sticker as per EPA & DEC NYS, further adding the identifier on ECU externally; stating the unit is for off road use + an affirmation.


    DMCA has provisions for sanctioned uses of the OBD2 Port ...........as does the EPA, and the OEM.

    This is not one of them.
    Such switch devices, port programmers or programs designed, to put by the proprietor, or the end user in such control to alter; are a violation.
    Therefore not Copyright Protected, TM, Patented, or Any type of IP whatsoever............ when such claims are made by the assholes that built the illegal Invention.

    The whole idea of off road use does not stand up to any close thought. pretty sure it is against the law to remove or disable emissions equipment. period.
    I would be very surprised (but willing to learn) at any provision in the current law which allows for removal of emissions equipment for off road use.


    the EPA has set emissions targets for off road equipment, and just like cars and trucks, the design gets qualified for sale in the US after it is demonstrated to meet what ever emissions targets are in place.. there are penalties for import or sale of equipment that does not meet the appropriate emissions targets.

    modifications of these emissions features before or after sale are against the law.

    there are exceptions in some state laws for actual historical reproductions, or museum displays, and actual race cars, but these are not for daily drivers.

    If a car originally sold with emissions equipment cannot be economically repaired, there is a recycling industry fully capable of extracting value from what is left.

    Yup that is true and also part incorrect........which is why I keep the components or add even more enhanced ones, as aforementioned in my twins thread.
    The CAT we use and for the race track is HUGE, it also costs over 2K USD.

    Some vehicles can be modified and used for competition sanctioned use. ( De-milled )
    What these hacks have been doing is illegal; and NOT "motorsports", that's the whole point of the thread.

    The provision is here and the guidelines are pretty clear.

    What requirements apply to excluded vehicles? There are two EPA requirements that apply to competition vehicles that are excluded from the regulations. First, as described above, if we exclude a vehicle, you may not use it for recreation. Second, if your vehicle is excluded because you modify an EPA-certified vehicle, you must destroy the original emissions label to show that it is no longer “certified” and may only be used for competition. Once you modify your vehicle, you may no longer use it for recreation. If you sell or give one of these engines to someone else, you must tell the new owner in writing that it may be used only for competition.
    In addition to these EPA requirements, state and local governments may have requirements or restrictions that apply to excluded vehicles. For example, a state may require you to register your competition vehicle, or may prohibit use of excluded vehicles on public land.
